Terms & Conditions
EXCLUSIVE HOLIDAY HOMES — TERMS & CONDITIONS OF BOOKING (DTCM Licensed Holiday Home Operator)
These Terms & Conditions govern all direct bookings made through the Exclusive Holiday Homes website.
By proceeding with a booking and making payment, the Guest confirms that they have read, understood, and agree to be legally bound by these Terms, which constitute a binding short-term occupancy licence agreement.
1. BRAND & CONTRACTING ENTITY
These Terms & Conditions are issued under the Exclusive Holiday Homes brand and apply to bookings made with Exclusive Holiday Homes Rental L.L.C. (DTCM Licence No. 1020028) (the "Manager").
Licensed Manager (as registered with DTCM): R Bridgman
The Manager is a duly licensed Holiday Home Operator in the Emirate of Dubai under the regulations of the Dubai Department of Economy and Tourism (DET / DTCM).
2. NATURE OF OCCUPANCY
The booking grants a short-term holiday home licence only for the dates and times confirmed for the booking.
No tenancy, leasehold interest, exclusive possession, or residential rights are created. The Guest has no right to remain in the Property beyond the agreed booking period. The Property is operated strictly for Holiday Home Activity in accordance with DTCM regulations.
3. IDENTIFICATION & REGISTRATION
In compliance with UAE law and DTCM regulations:
- All Guests must provide valid passport, Emirates ID, or (where applicable) KSA ID copies prior to or at check-in.
- Physical ID may be required to be presented at check-in.
- All occupants must be registered where required by building management, hotel management, community security, or authorities.
Failure to comply may result in refusal of check-in without refund.
4. PAYMENT TERMS
Payment must be made in accordance with the agreed schedule. Failure to make payment when due may result in cancellation of the reservation and forfeiture of any amounts paid. Returned or failed payments may incur administrative charges.
If the Guest is uncertain regarding payment terms, clarification must be sought from the Manager prior to the due date.
Cheque payments (if accepted): the validity of the booking is subject to cheque clearance. Returned cheques may incur a penalty and require alternative payment within three (3) days; failure may be treated as a breach and may result in eviction and/or reporting to relevant authorities where applicable.
5. EARLY DEPARTURE & NO-SHOW
- Early departure or reduction of stay: no refund.
- No-show: no refund.
Refunds (if applicable) are subject to deduction of non-recoverable payment processing or banking fees.
No refund or compensation shall arise solely due to dissatisfaction, change of preference, subjective expectations, neighbouring construction, hotel or nightlife activity, amenity closures, weather conditions, or other circumstances beyond the Manager's reasonable control.
6. SECURITY DEPOSIT & DAMAGE
A refundable security deposit may be required (by card, cash, or other method as specified). The Guest must notify the Manager in writing of any pre-existing damage within four (4) hours of check-in. In the absence of such notification, the Property shall be deemed accepted in good condition.
The Guest is liable for all damage, breakage, missing items, excessive cleaning, and losses arising during the stay, including any community/hotel fines or third-party penalties caused by the Guest or their visitors. Administrative charges may apply.
The Manager may apply the security deposit toward such costs and recover any shortfall from the Guest. The Manager may retain the security deposit for a reasonable additional period where damage assessment, third-party reports, community fines, or hotel/building management charges are pending. The balance (if any) will be returned once such matters are resolved.
7. CHECK-IN / CHECK-OUT / OVERSTAY
The Guest has the right to use the Property strictly between the agreed check-in and check-out times. The Guest has no right to occupy the Property beyond the agreed check-out time.
Unauthorised late checkout/overstay will incur a charge equal to the full nightly rate and may be charged at up to 200% of the nightly rate where operational disruption occurs.
If an overstay causes cancellation, relocation, or compensation of a subsequent booking, the Guest shall be liable for the resulting financial loss.
Following the stated check-out time, the Manager may enter the Property without further notice and remove belongings remaining in the Property. Items not claimed within seven (7) days may be disposed of without liability.
8. ACCESS DURING STAY
The Manager and its authorised representatives may enter the Property during the Guest's stay for maintenance, inspection, emergency, regulatory compliance, safety, security, or operational purposes.
Except in cases of emergency or urgent necessity, reasonable notice will be provided where practicable.
9. HOUSE RULES
The Guest agrees to all of the following:
A. Respect for Property & Neighbours: Respect and take care of the amenities, the Property and its contents, and neighbours. Refrain from uncivilised, inappropriate, or disruptive behaviour. The Guest is responsible for the conduct of all occupants and visitors.
B. Noise: If playing music or making noise, do so at a level which does not disturb neighbours and is not audible outside the Property. Quiet hours apply between 10:00pm and 8:00am.
C. Parties / Events / Commercial Use: The Property must not be used for parties, events, gatherings, or commercial activity unless agreed in writing in advance.
D. Third Parties (Catering, Events, Cleaners): The Guest must not bring third parties such as catering companies, event companies, entertainers, decorators, or external cleaning companies/cleaners unless agreed in writing in advance.
E. Pets / Animals: No pets or animals are permitted unless agreed in writing in advance.
F. Visitors & Overnight Restrictions: Visitors must be registered with the Manager and, where applicable, the residence reception, hotel staff, or community security. The Guest must not exceed occupancy and visitor limits. Visitors may not remain in the Property between 12:00 midnight and 8:00am. Guests are responsible for visitor behaviour.
G. Hotel / Building Amenities: Where applicable, visitors may only use hotel/building facilities if hotel/building staff have been notified and any applicable fees have been settled. From time to time, building/community/hotel amenities may be out of order or unusable; the Manager is not responsible for such matters.
H. Smoking: Smoking of any kind is strictly prohibited inside the Property. Any evidence of indoor smoking may result in forfeiture of the security deposit and additional charges.
I. Parking: Comply with vehicle parking rules and show consideration to others. Park only in authorised spaces.
J. Community / Building Rules & Law: Abide by developer/building management rules and all applicable UAE laws and DTCM regulations.
K. Garbage & Recycling: Dispose of garbage and recycling in allocated bins/areas. Do not leave rubbish in public or common areas.
L. Complaints / Disputes: Notify the Manager of any disputes or complaints as soon as practicable.
M. Check-Out on Time: Check-out on time. Late checkout/overstay charges apply as set out above.
Consequences of Breach: Breach of House Rules may, at the Manager's sole discretion, result in eviction and/or cancellation without refund, forfeiture of the security deposit, and additional fees/fines depending on severity.
10. KEYS & ACCESS CARDS
Keys and access cards will be provided as applicable. Loss and/or damage will attract a charge to the Guest.
11. EXTENSIONS OF STAY
Any extension of stay is subject to availability and prevailing rates at the time of extension. These Terms continue to apply to any approved extension.
12. COMPLAINTS, ISSUES, DISTURBANCES & UNAVAILABILITY
The Guest must report issues, damage, breakages, or neighbour complaints to the Manager immediately. The Manager is not liable for issues not promptly reported.
The Manager shall not be held responsible for disturbances due to neighbouring properties, construction/renovations, hotel activity, events, neighbouring restaurants, nightlife venues (including venues such as Praia where relevant), or other external sound sources.
The Manager is not responsible for mosquitoes/pests introduced through Guest actions (e.g., leaving doors/windows open) and will use reasonable efforts to address reported issues, but no refund is due solely on that basis.
No refund shall arise unless the Property is materially uninhabitable, meaning structural damage to the Property or complete failure of essential utilities (water, electricity, or air conditioning) which renders continued occupation unsafe or impossible.
If the Property is unavailable for use for any reason, the Manager may (at its discretion) provide a similar property, offer an upgrade at an additional cost, or cancel and refund unused nights, without further liability.
13. LIABILITY
The Guest occupies and uses the Property and any amenities at their own risk and must take reasonable care. Children and vulnerable persons must be supervised at all times.
The Manager is not liable for loss, injury, or damage arising from Guest negligence, misuse of the Property, failure to comply with these Terms, or failure to supervise.
To the maximum extent permitted by applicable law, the Manager's total aggregate liability arising out of or in connection with the booking shall not exceed the total accommodation amount paid by the Guest. Nothing in these Terms excludes liability where prohibited by UAE law.
14. FORCE MAJEURE
The Manager shall not be liable for failure or delay caused by events beyond reasonable control, including government action, travel restrictions, utility outages, or force majeure events. No compensation shall arise solely due to such events.
15. BREACH & ENFORCEMENT
Breach of these Terms may result, at the Manager's sole discretion, in termination, eviction without refund, forfeiture/application of the security deposit, recovery of additional losses, and/or reporting unlawful conduct to relevant authorities.
16. E-SIGNATURE / ACCEPTANCE
These Terms may be accepted electronically. By ticking acceptance on the website, making payment, or commencing the stay, the Guest agrees to be bound by these Terms even if no separate agreement is signed.
17. DATA PROTECTION / PRIVACY
The Guest consents to the Manager (and relevant service providers, owners, and authorities where required) holding and processing Guest data for legal, operational, administrative, and regulatory purposes, and sharing such data with competent authorities and service providers where necessary.
18. GOVERNING LAW
These Terms are governed by the laws of the Emirate of Dubai and applicable UAE federal law. Any disputes shall fall under the jurisdiction of the courts of Dubai.
